What is the difference between probation, parole and extended supervision?

    • Probation is an order by a Judge that an Offender serve a certain length of time under community supervision. The Offender is NOT in prison, instead he/she is in the community and is assigned to a Division of Community Corrections Agent for that court-ordered length of time. When an Offender is "on probation," he/she sees the Agent as indicated, must abide by specific rules, which may include paying restitution, undergoing drug testing, successfully completing treatment, etc. When an Offender is "on probation," if he/she violates the terms of their probation, it is possible that the Offender may be revoked (jailed/incarcerated for a period of time). Some jail time can be made a condition of the probation.

Parole is the early release from incarceration to the community supervision of a Division of Community Corrections Agent. Parole supervision will last until the Offender's maximum discharge date. For example, if an Offender was sentenced to ten years in prison, but was released after seven years, the Offender will still continue to be under the supervision of an Agent for the remaining three years. When an Offender is paroled, he/she sees the Agent as indicated, must abide by specific rules established by the Agent, which may include paying restitution, undergoing drug testing, successfully completing treatment, etc. If the Offender violates the terms of his/her parole, it is possible that the Offender may be revoked (jailed/re-incarcerated for a period of time).

Extended Supervision is the community supervision period of a sentence handed down for felonies committed on or after December 31, 1999 (under the Truth-in-Sentencing law) that includes initial confinement time in prison. Extended supervision also applies to certain misdemeanors committed on or after February 1, 2003. Offenders who violate prison rules may have additional days added to the confinement portion of their sentence. Once an offender completes the confinement portion of the sentence, he/she will be released and will be supervised by a Division of Community Corrections Agent. When an Offender is released into Extended Supervision, he/she sees the Agent as indicated, must abide by specific rules established by the Agent, which may include paying restitution, undergoing drug testing, successfully completing treatment, etc. If the Offender violates the terms of his/her extended supervision, it is possible that the Offender may be revoked (jailed/re-incarcerated for a period of time).
